EXPLANATORY NOTE
Previously, on October 24, 2016, the Company posted on its website a letter to its stockholders discussing its results of operations for the quarterly period ended September 30, 2016. Subsequent to the posting of this letter, but prior to the filing of the Company’s Quarterly Report on Form 10-Q with the Securities and Exchange Commission, the Company revised its accrual related to litigation based on new information received subsequent to the date of its letter to its stockholders.
ITEM 2.02 RESULTS OF OPERATIONS AND FINANCIAL CONDITION
On November 1, 2016, the Company posted on its website a revised letter to its stockholders discussing its results of operations for the quarterly period ended September 30, 2016. A copy of the letter is attached to this Current Report as Exhibit 99 and is incorporated herein by reference.
The information in this Current Report is being furnished, not filed, under Item 2.02 in this Current Report on Form 8-K.
