The undersigned, a bank, custodian bank or other nominee holder (the “Nominee Holder”) of transferable subscription rights (the “Subscription Rights”) to purchase shares of common stock, par value $0.01 per share (the “Shares”) of EMPIRE RESORTS, INC.
