On June 29, 2015, ABIOMED, Inc. issued a press release reporting that it has received confirmation from the United States Department of Justice that it has closed its investigation into the Company’s marketing of the Impella® 2.5 device without taking enforcement action. The United States Department of Justice initiated an investigation on October 26, 2012 and was seeking documents from the Company related to its marketing and labeling of the Impella® 2.5 device. A copy of the press release is set forth as Exhibit 99.1 and is incorporated herein by reference.
