ITEM 1.04Mine Safety – Reporting of Shutdowns and Patterns of Violations

 

On July 21, 2010, the Dodd-Frank Wall Street Reform and Consumer Protection Act (the “Act”) was enacted.   Section 1503 of the Act included new reporting requirements related to mine safety, including disclosing on a Current Report on Form 8-K the receipt of an imminent danger order under Section 107(a) of the Federal Mine Safety and Health Act of 1977 (the “Mine Act”) issued by the Federal Mine Safety and Health Administration (“MSHA”).

 

On Monday, June 22, 2015, Armstrong Coal Company, Inc., an operating subsidiary of Armstrong Energy, Inc., received an imminent danger order under Section 107(a) of the Mine Act at its Kronos underground mine in Ohio County, Kentucky (the “Order”).  The Order was issued when during a routine inspection, a representative of MSHA observed workers performing maintenance on an energized belt.  The Order was immediately terminated when the belt was de-energized. No injuries resulted from the condition described in the Order, and production has resumed.
