C. R. Bard, Inc. (“Bard”) today announced that, in connection with its suit against W. L. Gore & Associates, Inc. (“Gore”) for infringing Bard’s patent number 6,436,135 (the “‘135 patent”), the Court of Appeals for the Federal Circuit (the “Court of Appeals”), affirmed the decision of the U.S. District Court for the District of Arizona regarding its determination that Bard established standing and that the ‘135 patent was willfully infringed. Gore may petition for a rehearing by the Court of Appeals and/or review by the U.S. Supreme Court.
