On December 11, 2014, Actavis plc (the “Company”) issued a press release confirming that Judge Robert Sweet of the United States District Court for the Southern District of New York has announced an intent to issue a preliminary injunction apparently requiring the Company to continue distribution of NAMENDA® (memantine HCl) immediate-release tablets. A copy of the press release is attached hereto as Exhibit 99.1 and incorporated herein by reference.
