Item 7.01              Regulation FD Disclosure

New Enterprise Stone & Lime Co., Inc. (the “Company”) is reporting that it has received on February 14, 2013 from the lender under its $170.0  million asset-based secured revolving credit facility (the “ABL Facility”) among the Company, the lenders from time to time party thereto, and Manufacturers and Traders Trust Company as Agent, an extension of the delivery date of its financial statements for the second fiscal quarter ended August 31, 2012 to February 28, 2013 and its financial statements for the third fiscal quarter ended November 30, 2012 to April 1, 2013.
