On May 22, 2012, we announced our filing of a second patent infringement lawsuit against Tria Beauty, Inc. in the United States District Court for the District of Massachusetts (the “District Court”) for infringement of U.S. Patent No. 8,182,473 which issued on May 22, 2012. A copy of the press release announcing this second suit is set forth as Exhibit 99.1 and a copy of the complaint filed in the District Court is set forth as Exhibit 99.2, both of which are incorporated by reference herein.
