On May 21, 2012, BioDelivery Sciences International, Inc. (the “Company”) issued a press release announcing the Company’s receipt of a pre-launch milestone payment of $2.5 million from Meda AB in conjunction with the first country pricing approval in the European Union for BREAKYL (tradename for the Company’s ONSOLIS product in the E.U). An additional milestone payment of $2.5 million is payable at the time of commercial launch, which such payment is anticipated in the fourth quarter of 2012. A copy of such press release is attached as Exhibit 99.1 hereto.
