On January 28, 2012, CONSOL Pennsylvania Coal Company LLC, a subsidiary of CONSOL Energy Inc. and the operator of the Company’s Enlow Fork mine located in Enon, Pennsylvania (the “Enlow Mine”), received an imminent danger order (the “Order”) from the Mine Safety and Health Administration (“MSHA”) with respect to the Enlow Mine under Section 107(a) of the Federal Mine Safety and Health Act of 1977. The Order was abated within fifty-five minutes of its issuance, and then MSHA, after further investigation, vacated the Order on February 1, 2012.
