Item 8.01 Other Events.

On December 6, 2011, the Corporation received an order issued by the Mine Safety and Health Administration (“MSHA”) under section 107(a) of the Federal Mine Safety and Health Act of 1977 at its Weeping Water Mine in Weeping Water, Nebraska. The order stated that a miner was under the front of a service truck setting a jack to change a flat tire while the truck was parked on a slight grade downward. The order stated that there were no wheel chocks or other means of blocking the truck’s movement in use, and the truck’s parking brake was not set. Both wheel chocks and the parking brake were applied immediately. No one was injured in this event. The Corporation has requirements for prompt internal reporting in connection with matters of this type, which were inadvertently not followed in this case, resulting in a delay in the filing of this 8-K report. The Corporation has taken steps to strongly reinforce such internal reporting requirements.
